| SEA-DOO RETAIL PROMOTION RULES RULES. By entering a [Promotion full name] (the “Promotion”), Participants (as defined below) automatically agree to accept and abide by these official rules (the “Rules”). All decisions of the Promoter (as defined below) with respect to any aspect of this Promotion, including without limitation the eligibility of entries, are final and binding on all Participants in all matters as they relate to this Promotion. PROMOTION. The Promotion provides a discount of AUD 1,000 or NZD 1,000 (“Discount”) off the BRP authorized dealer’s price of a new, eligible personal watercraft purchased from an authorised BRP dealer. The Discount is limited to the first 300 in Australia and 100 in New Zealand eligible purchasers who complete a Qualifying Purchase during the Promotion Period (“Cap”). Once 300 in Australia and 100 in New Zealand Discounts have been allocated, the Promotion ends immediately. PROMOTION PERIOD. The Promotion period starts 7/01/2026 and ends 31/01/2026 the earlier of: (a) allocation of 300 (in Australia) and 100 (in New Zealand) Discounts under this Promotion; or (b) January 31, 2026 AEST(“Promotion Period”). PROMOTER. The Promotion is sponsored by BRP Australia Pty Ltd, Level 26, 477 Pitt St, Haymarket NSW 2000, Australia (“BRP” or the "Promoter"). ELIGIBILITY. This Promotion is open exclusively to existing owners of Sea-Doo personal watercraft (“Eligible Product”) who: (i) are aged 18+; and (ii) reside in Australia or New Zealand; and (iii) can provide acceptable proof of prior ownership (e.g., VIN/HIN, previous purchase invoice, registration certificate, or warranty record). Fleet, rental, and commercial buyers are excluded. Employee purchase programs are excluded. Employees of Promoter, their subsidiaries, distributors, dealer’s, vendors, service providers, affiliates and advertising and promotional agencies of Promoter, and their respective immediate families (spouse, parents, children, siblings and their spouses) and individuals living in the same household of such individuals (whether related or not), are not eligible. Commercial enterprises and business entities are not eligible to enter the Promotion. QUALIFYING PURCHASE means (i) a purchase contract signed and deposit paid during the Promotion Period for any new Sea-Doo personal watercraft in: NEW ZEALAND: A purchase contract signed and deposit paid during the Promotion Period for any new Sea-Doo personal watercraft in New Zealand from a BRP authorised dealer; and (ii) the purchaser satisfies Eligibility clause above; and (iii) delivery is taken by the 31st of Jan, 2026 unless delayed due to circumstances beyond the purchaser’s reasonable control (e.g., freight or manufacturing delays confirmed by the dealer). The Discount applies at point of sale and cannot be claimed retrospectively. Only available for the first 100 purchases during this promotional period. Once 300 in Australia and 100 in New Zealand Discounts have been allocated, the Promotion ends immediately. TRANSPARENCY & ALLOCATION Promoter’s dealers will allocate Discounts strictly in order of completed Qualifying Purchases recorded in the dealer’s system timestamp (local time). The Promoter will maintain a central record of allocations. If the Cap has been reached, dealers must inform prospective purchasers prior to concluding a sale. PRICING & EXCLUSIONS. Dealers are at all times free to set the price of the Promotional Product at their sole discretion. The Discount may be combined with selected other offers - see dealer for details. The Discount cannot be exchanged for cash, store credit, or applied to past purchases. Standard delivery, registration, insurance, accessories, and optional add-ons are excluded from the Discount unless explicitly stated on the contract. VERIFICATION. The Promoter and dealers may request reasonable documentation to verify ownership and eligibility. If documents are not provided or are inadequate, the Discount may be refused. CANCELLATIONS & REFUNDS. If a Qualifying Purchase is cancelled, the Discount is void. If the order is re-made, eligibility is reassessed against availability and the Cap at the time of the new contract. FAIR CONDUCT. The Promoter reserves the right to refuse the Discount where the Promotion has been misused or where fraud, manipulation, or other misconduct is suspected (acting reasonably and in compliance with applicable consumer laws). LIMITATION OF LIABILITY. Subject to non-excludable consumer guarantees under the Australian Consumer Law and New Zealand law, the Promoter is not responsible for indirect loss. Nothing in these Terms limits rights that cannot be excluded by law. PRIVACY. Personal information collected in connection with this Promotion will be handled in accordance with the Promoter’s Privacy Policy available at http://www.brp.com/en/privacy-policy.html. CHOICE OF APPLICABLE LAW AND CHOICE OF FORUM CLAUSE. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of Participants and the Promoter in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of New South Wales, Australia or New Zealand respectively. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable, these Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. Void where prohibited by law. PRIORITY. In the event of any discrepancy or inconsistency between the Rules contained herewith and the rules contained in any Promotion related materials, including but not limited to Promotion entry forms, marketing materials, short notice or advertisement of any sort, the terms and conditions of the Rules herewith shall prevail, govern and control over any other terms and conditions. TERMINATION. Subject to state regulatory approval, Promoter reserves the right to terminate this Promotion at any time without liability. Promoter is not responsible if, for any reason, its websites are not capable of running as planned, or for any infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Promoter which corrupt or affect the administration, security fairness, integrity or proper conduct of this Promotion or of any person's computer hardware or software. Subject to state regulatory approval, Promoter also reserves the right to terminate, modify or suspend the Promotion if Promoter is not capable of running it as planned for any reason beyond Promoter’s reasonable control.
